Food Vendor: Selling Food or Beverage
Space: AfroComicCon is only providing space to all Vendors, therefore you are responsible for all tenting, tables, chairs, etc … for your booth. Food Vendors must have Environmental Health approved “Food Tents.” All tables with a public view must be skirted and/or covered to ground level with black or white linen. All signage may not protrude outside of allocated space. You may not encroach upon neighboring space. If you need assistance in obtaining tents, tables, and/or chairs Producer can provide you with rental company information.
Permits: All Vendors (at your own expense) must have any and all permits required to vend within the City limits of Emeryville; a seller’s permit (California State Board of Equalization), business license, and a Health permit (Alameda County Environmental Health Department). Also, you must return all of these permits to us with your Vendor application. If the city doesn´t require of you any permits, (due to the fact that this event is on private property) please let us know. Additionally, if you are a Non-profit, or fiscally sponsored by a Non-profit you must provide a copy of their 501(C) 3 paperwork and a letter authorizing you to use their Tax ID.
Insurance: All Vendors must provide proof of their own liability insurance, and name the following as additional insured: (AfroComicCon) event as its subsidiaries, agents, contractors, employees and service providers if required upon request.
Please note: if you are a new and emerging food vendor and looking for a fiscal sponsor please let us know.
**Additionally all vendors should have current auto insurance for all vehicles entering the property.
Sales Tax: All Vendors selling anything must possess a resale number, collect taxes, and are solely responsible for payment of their own sales taxes. A resale number can be obtained from the California State Board of Equalization. Applications are not complete without a valid resale number.
Parking: Each Vendor will receive (1) one vehicle pass to park in a designated area additional parking passes are available for purchase at $10.00 per vehicle. Any vehicles parked in an unauthorized area of the event site will be cited and/or towed at the owner’s expense. You may not park near your booth. You must park in the designated area for vendors.
Set Up & Break Down: All booths must be set up and ready for business by 9:00 am the day of the show and you may not break down until 5 minutes after the end of the event at 6 pm. *Note: It is preferable that ALL VENDORS MUST LOAD IN AND SET UP ALL STRUCTURAL MATERIAL THE DAY BEFORE THE EVENT (I.E. TENTS, TABLES, CHAIRS, SIGNAGE, ETC…), you might be able to set up on Friday, October 19th at 6 pm the evening before the event. However, we will not be responsible for your property if you choose to leave it overnight. No security will be provided to you the night before.
Clean Up: Each Vendor is responsible for the condition of his/her space during and after this event. Each space must be kept neat and clean at all times during the event. Each vendor is responsible for bagging and disposing of all garbage and waste in designated areas. No food waste, grease or trash items will be left on or around your space.
Security & Liability: You are responsible for your booth, merchandise, and belongings at all times. Security will be present at the event site, but no representation as to the relative safety of your equipment or merchandise is implied or granted. Please do not leave valuables unattended. If you choose to leave equipment or merchandise unattended (overnight), you do so at your own risk. Insurance to cover these risks should be carried by the participants at no cost to the AfroComicCon or SAE Expressions College.
Food Handling: All Food Vendors must at all times follow all food handling requirements as ascribed by the Alameda County Health Department. Any breach in the food handling policy is a violation of the terms of this agreement, which may result in the immediate termination of this agreement, forfeiture of fees paid, and immediate closure of your booth. Please do not handle U.S. currency/money and food at the same time. There will be no water supply outdoors in your area, therefore, please bring your own washing and water supply.
Transactions: Vendor is responsible for all transactions/exchanges with Customers. At the end of the Event, Food Vendors will then settle with the Event Producers. If you have a problem with any attendee and are requesting them to leave please let the event producers know.
VENDOR RELEASE & HOLD HARMLESS AGREEMENT
This agreement is entered into by and between AfroComicCon 2018 (Event), AfroComicCon, (Producer) and the person filling out, signing, and returning the application (Vendor).
The “Producer” is in the business of providing space at the AfroComicCon (at the SAE Expressions Campus) for the display and sale of food and beverage.
“Producer” does not participate in the construction, assembly, or placement of the individual “Vendor’s” exhibit.
Vendor agrees to participate and/ or allow its name and image to be shown in all media. Vendor agrees to cooperate in any venture arranged by the “Producer” including but not limited to the following promotions; A.) Radio & Television promotion (Vendor may provide the “Producer” complimentary product at its discretion for promotional purposes).
The Vendor hereby indemnifies and holds the “Producer”, “Event”, AfroComicCon, City of Emeryville, SAE Expressions College, its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients, or its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients, harmless from any and all claims, including but not limited to costs and attorney’s fees resulting there from, arising out of said Vendor’s participation in this event. For the purpose of this agreement, the term “participation” shall include, but not be limited to, the delivery of equipment, merchandise, structures and product to their designated location, the set up and display of any such structure and arts or crafts, and the dismantling and removal of all such items from the area provided by or through the “Producer” or its agents, employees and service providers, contractors, volunteers or the Client or its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients.
The Vendor hereby expressly assumes any risk of harm to the Vendor arising out of their participation and the participation of other “Vendor” in the “Event”, including any risk resulting from the particular location of the space designated to them by the “Producer”. Insurance to cover these risks should be carried by the participants at no cost to the “Producer”.
This agreement shall be effective immediately upon execution and shall continue in effect throughout the event period.
Permits, Licenses and Insurance
Insurance – As a Vendor, you have and provide the AfroComicCon with a copy of your certificate of insurance. You must carry a liability policy, and automobile liability including your business listed below as “Additional Insured.” If you need an insurance reference you can use the company below. You can apply for insurance online with this company. When you go on to the website and register “Are you a Vendor”, the box and fill in all of the information. They will email you a quote and you can pay for policy via credit card.
